1. Agreement to Terms

These Terms of Service ("Terms") govern your use of veilsend ("the Service"), operated at veilsend.app ("we", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

veilsend provides end-to-end encrypted file sharing. Files are encrypted in your browser before upload using a passphrase you choose; our servers store only encrypted ciphertext. Files are shared via links and are automatically deleted when they reach their expiry time.

The Service is designed for the private, secure transfer of files between individuals and teams. It is not a public file hosting, content distribution, or backup service.

3. Accounts

• You must provide a valid email address to create an account (directly, or via Google sign-in).
• You are responsible for all activity under your account and for keeping your credentials secure.
• You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service.
• One person may not maintain multiple accounts to circumvent plan limits or abuse controls.

4. Your Passphrase — Important

File passphrases are never transmitted to or stored by us. If you lose a passphrase, the file cannot be recovered — by you or by us. This is a fundamental property of the Service's zero-knowledge design. You are solely responsible for remembering and securely sharing your passphrases.

5. Acceptable Use

You agree not to use the Service to store, share, or distribute:

• Content that is illegal in any applicable jurisdiction
• Child sexual abuse material (CSAM) — zero tolerance; we report to relevant authorities
• Malware, viruses, ransomware, phishing kits, or any malicious code
• Content that infringes intellectual property rights (pirated software, media, or documents)
• Content promoting terrorism, violence, or hate speech
• Stolen data, credentials, or personal information of others obtained without authorization
• Any content facilitating fraud, scams, or deception

You also agree not to:

• Probe, scan, or test the vulnerability of the Service, or circumvent security or rate limits
• Interfere with other users' use of the Service, or attempt to access files not shared with you
• Use automated means to mass-upload or mass-download files
• Misrepresent the Service's origin or resell access without our written permission

Because files are encrypted, we cannot proactively review content. We act on reports and technical indicators of abuse. To report abuse, contact [email protected]. We may remove reported files and suspend accounts that violate these Terms, without prior notice where warranted.

6. Subscriptions and Payment

• Plans. The Service offers a Free plan and a paid Pro subscription, as described on the pricing page. Plan limits (file size, storage, retention) are enforced automatically.
• Billing. Paid subscriptions are billed by Creem, our Merchant of Record, which appears on your payment statement. By subscribing, you also agree to Creem's buyer terms.
• Auto-renewal. Pro subscriptions renew automatically each billing period until cancelled. You authorize recurring charges to your payment method.
• Cancellation. You may cancel at any time; the subscription remains active until the end of the current paid period, after which your account returns to the Free plan.
• Refunds. Governed by our Refund Policy.
• Price changes. We will provide at least 30 days' notice of subscription price changes; continued use after the effective date constitutes acceptance.

7. File Storage and Retention

• Files are stored only until their expiry time and then permanently deleted. Expired files cannot be restored.
• The Service is not a backup solution. Do not rely on it as your only copy of any file.
• We may enforce plan limits by rejecting uploads that exceed them. Downgrading to Free does not delete existing files immediately, but files remain subject to their expiry times and new uploads are limited to Free plan limits.

8. Intellectual Property

You retain all rights to files you upload. You grant us only the limited license needed to store and transmit your encrypted files to provide the Service. The Service itself — its software, design, and branding — is our property and may not be copied or reused without permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that files will never be lost. You use the Service at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR USD 50 IF YOU PAID NOTHING).

11. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate accounts that violate these Terms, with or without notice, and may retain records as required by law or for abuse investigation.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
